1. ATerms of Service
These Terms of Service (“Terms”) are a legal agreement between you and Every Shade of Infertility, LLC (“we,” “us,” “our”) governing your use of the Every Shade of Employers application and related services (“the App”). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be 18 years or older to use the App.
2. What the App is — and is not
The App helps you find and compare employers' fertility benefits, evaluate job offers against your family-building journey, and connect with a peer community.
The App provides peer support and informational tools only. It does not provide medical, legal, tax, or financial advice. Information in the App — including employer benefit details, evaluation results, community posts, and reviews — is for general informational purposes and may be incomplete, out of date, or inaccurate. Always confirm benefit specifics directly with the employer, and consult a qualified professional (such as a doctor, attorney, or financial or benefits advisor) before making decisions. You rely on information in the App at your own discretion.
3. Your account
You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.
4. Membership, billing, and pricing
Free and paid features. Some features are free. Others require a paid membership. Certain free features (such as a limited number of free employer “unlocks”) are offered once per person. We use anti-abuse measures, and deleting and recreating an account does not restore free features.
Subscriptions. Paid memberships are recurring subscriptions billed in advance on a recurring basis until cancelled. By subscribing, you authorize us (and our payment processor, or the applicable app store) to charge your payment method on each renewal.
Price lock. If you joined at a promotional or founding-member rate described as “locked for life,” that rate applies only for as long as your membership remains continuously active. If you cancel and later rejoin, you will be charged the then-current price, and the prior locked rate will no longer be available.
Cancellation. You may cancel anytime in Settings (or, for app-store purchases, through your app-store account). Cancellation stops future renewals. Except where required by law, payments already made are non-refundable, and you retain access through the end of your current billing period.
App-store purchases. If you purchase through the Apple App Store or Google Play, that store's billing terms also apply, and cancellations/refunds may be handled through your app-store account.
Earned free time. Free membership time you earn (for example, through referrals or approved tips) is applied according to the rules shown in the App and may have time limits. It has no cash value and is non-transferable.
Price changes. We may change prices for new members or for renewals with notice as required by law; changes do not affect a validly locked rate while your membership stays active.
5. Community, reviews, tips, and your content
When you post in the community, write a review, submit a correction or tip, or upload content, you are responsible for that content. You agree to follow our Community Guidelines, which are part of these Terms.
You agree not to:
- Post content that is unlawful, harassing, hateful, defamatory, deceptive, or that violates others' privacy or rights;
- Share another member's posts, story, or personal information outside the community;
- Post others' content as your own, or spread false information about employers, clinics, or people;
- Advertise, spam, recruit, or promote outside products, services, or groups;
- Post explicit, graphic, or harmful content.
Reviews reflect individual experiences, not verified facts. We review submitted content and may edit, refuse, remove, or decline to publish it, and may warn or remove members, to protect the community.
License to your content. You keep ownership of what you create. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and use the content you submit to operate and promote the App and community, consistent with our Privacy Policy and your privacy choices.
6. Our content and your conduct
The App, including its design, text, the employer benefits database, and other materials, is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-transferable license to use the App for its intended purpose.
You agree not to:
- Copy, scrape, harvest, redistribute, resell, or create derivative works from the employer database or other App content;
- Attempt to access data you are not authorized to access, or circumvent paywalls, unlock limits, or security measures;
- Reverse engineer, interfere with, or disrupt the App;
- Use bots or automated means to access or extract data.
7. Data we collect and how we use it
Your use of the App is also governed by our Privacy Policy, which explains how we handle your information. In addition to the account information you provide, please note the following:
Anonymized usage data. To improve our tools and better serve our community, we collect anonymized information about how our evaluation and comparison tools are used — such as the family-building paths, benefit types, dollar amounts, and general situations people run through the tools. This information is stripped of identifying details before it is stored: it is never linked to your name, email, or account, and we do not store the employer names you enter. We use it only in aggregate — to understand patterns, honor the many different journeys our members are on, and make our tools smarter and more helpful over time. We never sell this data, and we never share it in a form that could identify you.
Your privacy. We designed this to respect you: every record we keep about how the tools are used is a situation, never a person. For full details on what we collect, how we store it, and your choices, please see our Privacy Policy.
8. Account deletion and termination
You may delete your account at any time in Settings. We may suspend or terminate your access if you violate these Terms or the Community Guidelines, or to protect the App or its members. Provisions that by their nature should survive termination will survive.
9. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App or its information will be accurate, complete, current, uninterrupted, or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Every Shade of Infertility, LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the twelve months before the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Every Shade of Infertility, LLC from claims, losses, and expenses arising from your content, your use of the App, or your violation of these Terms.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date and, where appropriate, notify you in the App. Continued use after changes means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State in which Every Shade of Infertility, LLC is organized, without regard to conflict-of-law rules, except where local consumer-protection law requires otherwise.
